Terms of Use

These terms are an agreement between you and Fatum LLC, a Wyoming limited liability company (“Fatum”, “we”, “us”), for your use of the Yolk iPhone app and this website (together, “Yolk”). By creating an account or using Yolk, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Yolk.

Apple's Licensed Application End User License Agreement (the “Standard EULA”) also applies to your use of the app. These terms add to it; if the two conflict, these terms apply to the extent the Standard EULA allows.

1. You must be 18 or older

Yolk is only for adults 18 and older. By using it, you confirm that you are.

2. Not medical advice

Talk to your doctor before you change how you eat, and before following a Yolk plan, if any of these apply to you:

• you are pregnant, trying to become pregnant or breastfeeding;
• you have diabetes or prediabetes, kidney disease, heart disease, high blood pressure or any other medical condition;
• you take medication, including Ozempic, Wegovy, Mounjaro or similar medications;
• you have, or have had, an eating disorder;
• you plan to carb-load, train for an endurance or athletic event, or follow any performance plan.

Stop and seek medical help if you feel unwell. In an emergency, call your local emergency number. Results vary from person to person, and we don't promise any particular weight, body change or health outcome.

3. Estimates can be wrong

• Your daily calorie and protein targets come from a standard formula and the answers you give. They are estimates, not measurements of your body.
• When you scan your fridge or a meal, an AI model recognizes the food in the photo. It can miss items, mistake one food for another, or misjudge a portion, so calorie and macronutrient estimates based on photos can be wrong. Check the result and correct it before you rely on it.
• Nutrition values for recipes are calculated from typical ingredient data and can differ from what you actually cook or buy.
• Allergies: Yolk leaves out recipes with the allergens you tell us about, but it can't know every ingredient in a packaged product or restaurant dish, and a photo scan can't detect allergens. Always read labels and ask when eating out.

4. Your account

You sign in with Apple or Google. If you scan a photo before signing up, Yolk uses a temporary anonymous account, which is linked to your account when you sign in where possible. Keep access to your Apple or Google account secure; you are responsible for activity on your Yolk account. Give us accurate information, because your plan is built from it. You can delete your account at any time in the app under You → Delete account.

5. Subscriptions and free trials

Some features of Yolk require a paid subscription. Subscriptions are sold and billed by Apple through the App Store, under Apple's terms.

• Plans. Yolk offers a yearly and a monthly subscription. The price, currency and billing period are shown in the app and on Apple's purchase screen before you confirm.
• Free trials. When offered, the yearly plan starts with a 14-day free trial and the monthly plan with a 3-day free trial. Apple decides eligibility, usually one introductory offer per Apple Account. Nothing is charged during the trial.
• Automatic renewal. When a free trial ends, your subscription starts and your Apple Account is charged for the plan you chose, unless you cancel at least 24 hours before the trial ends. After that, your subscription renews automatically for the same period at the then-current price, and your Apple Account is charged within 24 hours before the end of each period, unless you cancel at least 24 hours before it ends.
• Cancelling. Cancel anytime in iPhone Settings → your name → Subscriptions, or from the Yolk app under You → Manage. You keep access until the end of the period you paid for. Deleting the app or your Yolk account does not cancel a subscription.
• Refunds. Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. We can't issue refunds for App Store purchases.
• Price changes. If the price of your subscription changes, Apple will tell you in advance and, where required, ask for your consent before the new price applies.
• Restoring purchases. If you change phones, use Restore purchases in the app with the same Apple Account.
• Trial reminder. If notifications are on, Yolk shows a notification on your phone two days before a free trial ends. It is a courtesy, and Apple's renewal terms apply whether or not you see it.

6. Acceptable use

Use Yolk only for your own personal, lawful meal planning. Don't:

• break the law or anyone's rights using Yolk;
• upload photos of other people, or anything illegal, harmful or that you don't have the right to share;
• try to access other people's accounts or data, or get around scan limits or other security features;
• copy, scrape, reverse engineer or overload the app or our servers, or use automated tools to access them;
• resell, sublicense or redistribute Yolk or its recipes and plans.

7. Your content

Your answers and photos are yours. You give us a limited, non-exclusive license to store, process and display them only to provide Yolk to you, as described in our Privacy Policy, including sending fridge and meal photos to our AI provider to recognize food. The license ends when you delete the content or your account, except for copies the law requires us to keep.

8. Our content

Yolk, including its recipes, plans, design, text, the Yolk name and the egg logo, belongs to Fatum or its licensors. We give you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the Standard EULA and Apple's Usage Rules. Recipes and plans are for your personal use.

9. Third-party services

Yolk relies on services from Apple, Google, RevenueCat, Supabase and Anthropic. Your use of Apple and Google sign-in and of the App Store is also subject to their terms. We aren't responsible for third-party services we don't control.

10. Changes to Yolk and to these terms

We may add, change or remove features, and Yolk may sometimes be unavailable. We may update these terms; if a change is significant, we will tell you in the app before it takes effect. If you keep using Yolk after the change, the updated terms apply. If you don't agree, stop using Yolk and cancel your subscription.

11. Ending your use

You can stop using Yolk and delete your account at any time. We may suspend or close an account that breaks these terms or puts other people or Yolk at risk. Sections 2, 3, 7, 8 and 12 to 17 continue to apply after your use ends.

12. Disclaimers

To the extent the law allows, Yolk is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of nutrition estimates, and uninterrupted or error-free operation.

13. Limitation of liability

To the extent the law allows, Fatum and its members, managers and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Yolk. Our total liability for all claims relating to Yolk is limited to the greater of what you paid for Yolk in the 12 months before the claim and US$50. Some places don't allow these limits, so they may not fully apply to you. Nothing in these terms limits liability that can't be limited by law, or rights you have as a consumer that can't be waived by contract.

14. Indemnity

If you break these terms or the law while using Yolk and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

15. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Wyoming. If you live in a country whose consumer laws give you the right to bring claims in your local courts or under your local law, those rights are not affected. Before bringing a claim, please email us so we can try to resolve it informally.

16. Apple

These terms are between you and Fatum, not Apple. Apple is not responsible for Yolk or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, and intellectual property infringement claims. If Yolk fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.

17. General

If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a right, we haven't waived it. You may not transfer these terms; we may transfer them to a successor of our business. These terms, the Privacy Policy and the Standard EULA are the entire agreement between you and us about Yolk.
